Selene finance purchased our modified loan from BOA that we had been making

Payments on for several months. We were not immediately notified of the transfer and sent our next payment to BOA as usual. BOA then informed us of the transfer and said they would forward the payment to Selene. Selene finally contacted us and informed us we would have to reapply for a new modification. Thi I told my husband I didnt think that could possibly be legal. How can someone just buy your loan, then just decide not to honor the agreement already in place on the loan and force you to reapply under their terms, which are strictly whatever impossible measures they require to force fireclosure. Against our will, feeling we had no say in it, we once again went through the arduous ordeal of getting a modification.

They gave us until April 9th to get all docs to them. Done. Despite our efforts to stay updated on the status of our loan, they didnt respond.

On April 29 2016 they sent a notice of trustees sale via regular US mail. Shocked and terrified, we called them and were told that we had failed to sign our tax return. And needed to submit a hardshi letter. Let me say here thatin 26 years of marriage we had never once paid our mortgagte late or missed a payment until my husband fell from a scaffolding and was injured. We have lived in this home for 16 years. After recovering from his injuries, we were no longer having any hardship but having been unable to pay our mortgage for a while during that time required us to seek modification on our 30 year fixed mortgage that had been purchased by BOA when Country wide went under.. Obtaining a mod. Through BOA was nothing short of *** and a lawsuit was finally threatened to get them to stop denying, stalling, back peddaling etc. And finally get us modified.

Regardless we sent Selene all req. Paperwork with time to spare before the dealine and they told us they would POTPONE the sale pending review and acceptance into THEIR mod. Program. This was May 7th. May 15th and 16th my husband calls to ask about the status of our loan. Both days they put him on hold for over 30 min. Then disconnect him. He cant get back through. May 18th, no answer. May 19th, he gets through. They tell him our home was foreclosed on the 16th. Reason; There wasnt time to review our file. We are suing.

Reason of review: Poor customer service.

I am having similar situation with Selene. How is the lawsuit against them coming along, I am thinking of possibly doing the same.

They cancelled the sale on our house, because they want us to agree to a ridiculous modification, which I know that they will take our money for 3 months and then deny the final modification.

Our deadline to accept the modification is tomorrow and I think we are going to decline, but I am curious about filing a suit against them. This has been a nightmare to say the least!!
