If you are having problems with any mortgage servicer there are very precise steps which must be taken to gain any mileage with your servicer and the courts. I am not an attorney and I do not play one in real life.

I am routinely asked to review and comment on the best practices around loan origination, underwriting, servicing and securitization. It is simply not enough to claim things happen without a more cognizant argument. When any servicer fails to properly account for scheduled periodic payments their are sequential steps that must be taken to assert more than a violation of RESPA. In reviewing client files there is a "entire" look starting with the loan organization up to and including the most current correspondence.

If you want a viable shot at prevailing on the merits of your claims there are steps that must be taken. 1) Find a consumer protection attorney 2) Find a subject matter expert to testify 3) be prepared to pay fees and costs to have any real shot at prevailing 4) research your team and your state laws-rules-regulations. 5) Gather all documents and keep all envelopes and mailings, including solicitations 5) Do not let the statute of limitations run out on you check with your state regulations and ask an attorney 6) How were you harmed and what is is worth? These are the real questions and without an expert report, will be nearly impossible to quantify.

You won't have any trouble with anyone as long as you pay your bill on time and keep very good records. Sketchy vendors must be met with Certified Mail return receipt requested but being a sketchy customer is a means to its own end.

Not exactly true. What happens when you DO pay everything on time, early even and keep excellent records but they decide to 1.

Not credit your account until it is considered past due so they can charge you a fee (even when you sent the payment 15 days in advance) 2. Add on bogus fees and refuse to explain or remove them, causing your account to be in arrears because you had no idea they were going to pull this new scam. It's not always the consumer being irresponsible, most of these companies are incredibly dishonest.

We sued our last mortgage servicer 3 times (won every time) but they sold us to these scam artists and the problem started literally with the first statement showing us in arrears. Thankfully, we are able to have an attorney representing us but what about people who can't?

Thank you for your reply We are experiencing this with crooked Ditech .Our loan is.niw being serviced by Selene Finance which is worst than Ditech. We have contacted legal aid to assist us because we are Hurricane Harvey disaster victims.

It doesnโ€™t matter with Selene. They will lie and scam people no matter what.

We pay 2 weeks ahead and have for 6 years, we keep up with exact tax and insurance amounts. The 2 years we have been with Selene, has been horrendous. They are constantly trying to up our payments and screw us. We are in the middle of refinance with another company and they are refusing to give us or the other company the payoff statement.

We have now retained a lawyer. They are still trying to screw us.
